Account Information: Certain visitors to Fofo’s services choose to interact with Fofo in ways that require Fofo to gather personally-identifying information. The amount and type of information that Fofo gathers depends on the nature of the interaction. Some of our services require you to set up a basic Fofo account, so we need to collect a few important details about you, such as: a username, a password, an email address, a phone number, full name, display name, moniker (pseudonym), profile pictures, etc. We may use your phone number to verify your Account and if you provide Fofo with your phone number, you agree to receive missed calls / text messages to that number from Fofo. Additionally, our customer service may contact and communicate with you, if necessary. We may use your email address to verify your Account and to communicate with you, as described in more detail below. You can keep yourself fairly anonymous on Fofo, but remember that your posts, comments, shares, username, etc are all visible to the public by default. Note that we will never email you to ask for your password or other Account Information; if you receive such an email, please forward it to us.

Information about you on third-party services:

If you create a Fofo account by connecting with a third-party service, such as Facebook, Twitter, Google, YouTube, Instagram or VK, or if you connect a Fofo account with a third-party account, we will use information from such third-party service, including your third-party service user name, gender, profile image and birthday. We use your birthday to determine whether you have reached the minimum age to avail our Services. We use your contact information, such as your phone number, to authenticate your account, and keep your account as well as our Services secure.

User Content:

By default, all sharing through the Services is public, and when you provide us with content it is published so that anyone can view it. Content published and shared publicly is accessible to everyone, including search engines. In addition, information shared publicly may be copied and shared throughout the Internet, including through actions or features native to the Services, such as Sharing, Resharing, forwarding, etc. At its core, Fofo is a public platform. Don’t be afraid to share amazing things, but do understand that it can be hard to completely remove things from the internet once they’ve been shared or reshared a few times.

Native Actions:

The Services allow you to perform native actions that are integral to our products, such as liking a post, commenting in a post, sharing a post, replying to a post, etc. Liking, sharing, and replying are public actions – anyone can expand the “activities” view on a post, for example, to see who liked, shared, or replied to a post. We use information about native actions to improve the Services, develop new Services, and, particularly, to personalize your Fofo experience. Personalization using this information may include presenting you with new posts relevant to what you’ve liked, providing you with better search results, and showing you advertising more relevant to your interests When you share information or content like text, photos, videos, gifs, etc as well as shares, likes, replies, comments, etc via the Services, you should think carefully about what you are making public.

Information About User Content:

In some cases, we may collect information about content you provide to the Services. For example, if the recipient has viewed the content, replayed the content, and the metadata that is provided with the content. When it's included as part of your images, we may collect information describing your camera, camera settings, or EXIF information. This information allows us to improve the Services and provide additional features and functionality.

Camera and Photos：

You agree that you have the right to submit anything you post and you agree that you will not: Post or submit any content that infringes any patent, trademark, trade secret, copyright, or other intellectual, personal or proprietary right of any party. Post or submit any content that is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful or illegal in any manner whatever. Post or link to any malicious code, phishing sites, or other content that may threaten Internet security.

Post or submit any content that threatens the unity, integrity, defence, security or sovereignty of any nation or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any nation. The Site is a place with many third-party hyperlinks posted or submitted by users like you. Fofo is not responsible for the content or actions of any third party websites or services associated with posted or submitted links. You agree to take sole legal responsibility for any links you post or submit, and neither this Agreement nor the Site's privacy policy applies to any content on other websites related to those links. You should consult the terms and privacy policies of those other websites to understand your rights.

Spam

You may not post or submit any graphics, text, photographs, images, video, audio or other material that Fofo deem to be junk or spam. Cluttering the Site with this sort of content reduces the quality of the Site experience for others.

Disruption of Services

You agree not to interrupt the Site, introduce malicious code onto the Site, make it difficult for anyone else to use the Site due to your actions, or assist anyone in misusing the Site in any way.

Children and the Site

The Site is not directed at people under the age of 17, and the Site does not knowingly collect any personal information from such people.

Copyright

Fofo is not liable for any infringement of copyright arising out of materials posted on or transmitted through the site, or items advertised on the site, by end users or any other third parties. You are solely responsible for any damage to your computer or mobile device, loss of use, or loss of your user content. Fofo does not guarantee that the Site will always work properly.

Limitation of Liabilities

Fofo will not be liable for any special, consequential, indirect, incidental, punitive, reliance, or exemplary damages, whether in tort, contract, or any other legal theory, arising out of or in any way connected with this Agreement or your use of or attempt to use the Site, including (but not limited to) damages for loss of profits, goodwill, use, or data. You agree to release Fofo, its affiliates, and third-party service providers, and each associated director, employee, agents, and officers, from claims, demands and damages (actual and consequential), of every kind and nature, known and unknown, disclosed or undisclosed, arising out of or in any way connected to your use of the Site.

Severability and Waiver

If any provision of this Agreement is held invalid or unenforceable, that provision will be modified to the extent necessary to render it enforceable without losing its intent. If no such modification is possible, that provision will be severed from the rest of this Agreement. If Fofo does not enforce any right or provision in this Agreement, that is not to be deemed a waiver of Fofo's right to do so in the future.

Entire Agreement and Amendments

This Agreement is the entire agreement between you and Fofo concerning the Site. It supersedes all prior or contemporaneous agreements, proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between you and Fofo. Fofo may modify this Agreement at any time. If Fofo make changes to this Agreement that materially affect your rights, we will provide advance notice and keep this edition available as an archive on the Site website. By continuing to use the Site after a change to this Agreement, you agree to those changes.

Assignment

These terms of the Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Fofo without restriction.

Refund Policy

Unless otherwise specified, services purchased from the Sites are not refundable after purchase.

Account Terminations/Suspensions

In order to maintain a safe environment for users on Fofo, we may suspend accounts that violate the Fofo Terms & Policies. Users whose accounts have been terminated are prohibited from accessing, possessing or creating any other Fofo accounts.

Reasons accounts are terminated:

Violations:
Repeated violations of the Terms of Service or Policies of Fofo (such as abusive, hatred, harassment, impersonation, inappropriate, etc).

Spam:
Most of the accounts are suspended because they are spammy, or just plain fake, and they introduce security risks for Fofo and its users.

Account security at risk:
If we suspect an account has been hacked or compromised, we may suspend it until it can be secured and restored to its real account owner in order to reduce potentially malicious activity caused by the compromise.

Other reason:
Any other reason that Fofo deems to be a reasonable reason enough to suspend the account.

Unsuspend Account:

If you feel that your account has been suspended in error you may appeal the suspension by email to fofochat@163.com

Other Terms

This Agreement constitutes the entire agreement of agreed items and other relevant matters between both parties. Other than as stipulated by this Agreement, no other rights are vested in either Party to this Agreement. If any provision of this Agreement is rendered void or unenforceable, in whole or in part, for any reason, the remaining provisions of this Agreement shall remain valid and binding. The headings within this Agreement have been set for the sake of convenience, and shall be disregarded in the interpretation of this Agreement.
